The court hears the evidence and assesses the impossibility of continuing the marital life. This path is considered protection for the wife in case of the husband's arbitrariness or refusal to divorce. The ruling is issued after reconciliation sessions and attempts at reform. The divorce here is often final (ba'in).

5) **Suspended and Conditional Divorce**

A husband may link divorce to a condition, such as "If you leave the house, you are divorced." The court verifies the fulfillment of the condition and the husband's intention at the time of uttering it. This type is sensitive because it may occur unintentionally if the condition is met. The court decides each case according to its circumstances. It may consider some conditions invalid if they are arbitrary or illogical.

The legal consultant accurately determines the type of divorce and gathers the necessary evidence to prove it before the court.
